David Strite and Rachel Dearmond successfully defended a cardiology practice against claims for medical malpractice in Vanderburgh Circuit Court in Evansville, Indiana. Plaintiffs alleged that the cardiology practice failed to timely notify the patient of the results of an echocardiogram and the alleged delay caused the patient to suffer respiratory arrest and require emergency heart surgery. Strite and Dearmond argued that the employees of the cardiology group communicated the results of the echocardiogram to the ordering physician and made reasonable attempts to contact the patient. They further argued that the bacteria causing the Plaintiff’s infection would not have responded differently to earlier treatment. The jury returned a unanimous verdict in favor of the cardiology group.
