David Strite and Rachel Dearmond successfully defended a radiologist against claims of medical negligence in Hamilton County, Indiana. Plaintiff alleged that the radiologist failed to interpret her mammogram as abnormal and call the patient back for additional evaluation. Plaintiff was diagnosed with breast cancer approximately 14 months later. Strite and Dearmond presented evidence that Plaintiff had dense breast tissue which causes mammograms to become more difficult to read as the dense breast tissue is likely to obscure small masses. The defense also presented causation evidence to rebut Plaintiff’s allegations that her treatment, prognosis, and outcome would have been different had she been diagnosed 14 months earlier. The jury returned a unanimous defense verdict in favor of the radiologist.
