Mark Hammond and Rachel Dearmond received a unanimous, 6-0 defense verdict in an alleged physician negligence action in Floyd County (IN) on August 16, 2024. In the 1 week trial, Plaintiff alleged the defendant physician negligently implanted a pacemaker where Plaintiff suffered from only vasovagal syncopal episodes. Plaintiff requested $5 million in damages for pain and suffering, in part related to follow-up procedures needed due to lead repositioning and infection. Hammond and Dearmond defended by submitting proof that the defendant physician accurately diagnosed Plaintiff with symptomatic bradycardia resulting in 3 syncopal episodes. Plaintiff’s telemetry records showed heart rates in the 30s and 40s during a 3-day hospital stay, necessitating the pacemaker. The jury returned with a unanimous defense verdict after deliberating for approximately 2 hours.
