Mark Hammond and Rachel Dearmond successfully defended a cardiothoracic surgeon in a medical negligence lawsuit in Floyd County, Indiana. Plaintiff alleged that Defendants implanted an unnecessary pacemaker. Hammond and Dearmond put on evidence to establish that Plaintiff’s pacemaker was necessary for the safety of her and others as she experienced multiple fainting episodes with heartrates in the 30s and 40s. The defense also put on evidence to establish that Plaintiff’s pacemaker continues to pace and provide her benefit despite claims that it was unnecessary. The Floyd County jury deliberated and returned a unanimous defense verdict.
