David Strite and Rachel Dearmond successfully defended a board-certified orthopedic surgeon against claims of medical negligence in Boyle Circuit Court in Danville, Kentucky. Plaintiff alleged that the orthopedic surgeon failed to obtain a complete release during a carpal tunnel procedure which resulted in permanent nerve damage. Strite and Dearmond presented evidence that an incomplete release is a recognized complication of a carpal tunnel procedure. The defense also presented causation evidence to rebut Plaintiff’s allegation that the incomplete release caused permanent nerve damage. The jury returned a unanimous defense verdict after deliberating for 12 minutes.
