Clay Edwards and Morgan Blind successfully defended a Louisville dermatologist against claims for medical malpractice in Jefferson Circuit Court. Plaintiffs alleged that Defendant negligently failed to monitor their daughter with CBCs during isotretinoin, a medication prescribed for acne, treatment. Plaintiffs also claimed that Defendant failed to obtain proper informed consent by not informing them that she would not be monitoring CBCs during isotretinoin treatment. Plaintiffs claimed that isotretinoin caused their daughter to develop aplastic anemia which led to her death. Edwards and Blind argued that Defendant appropriately monitored Plaintiffs’ daughter during isotretinoin treatment. The defense also argued that even if CBCs had been ordered during treatment, it would not have impacted her development of aplastic anemia or death. Finally, they argued that isotretinoin was not the cause of Plaintiffs’ daughter’s aplastic anemia or death. At the end of trial, Plaintiff asked the jury to return a verdict for approximately $25 million. The jury agreed with Edwards and Blind and rendered a unanimous verdict in favor of the Defendant.
