Clay Edwards and Morgan Blind successfully defended two Indiana orthopedic healthcare providers against claims for medical malpractice in Batholomew Superior Court. Plaintiff alleged that Defendants failed to diagnose an ischemic foot caused by an arterial blood clot in her right leg which led to the amputation of her right leg. Edwards and Blind argued that Plaintiff’s complaint of pain in her lower back that radiated into her right lower extremity made to Defendants was consistent with lumbar radiculopathy and appropriately diagnosed. The defense argued that the arterial clot was not present at the time of the care and treatment provided by Defendants. Instead, the defense argued that the arterial blood clot was caused acutely by atrial fibrillation the day shortly before Plaintiff was diagnosed with an arterial thrombus at the hospital. Thus, it could not have been diagnosed by Defendants during their care and treatment. The jury agreed with Edwards and Blind and rendered a unanimous verdict in favor of the Defendants.
