James Grohmann successfully defended a surgical group in Fayette Circuit Court. Plaintiff alleged the surgical group failed to timely submit insurance preauthorization for a bilateral mastectomy, resulting in the denial of the contralateral prophylactic mastectomy. The prophylactic procedure was approved one day after plaintiff’s surgery, and she subsequently underwent another operation. Plaintiff experienced wound healing complications with both surgeries and plastic reconstructive efforts. Grohmann defended the case by establishing that it is ordinary practice to submit preauthorization on the day before surgery. The jury agreed and entered a defense verdict after thirty minutes of deliberation.
