In April 2014, Noel Halpin obtained summary judgment for an insurance carrier in Jefferson County, Kentucky.  The insurance carrier was a third-party defendant in a personal injury action arising from a deck collapse while the Plaintiffs were on the deck.  The insurance carrier issued policies to the construction company that built the decks 25 years earlier.  The Court agreed with the insurance carrier that the occurrence based CGL policy issued 25 years prior to the occurrence provided no coverage for the personal injury that did not occur within the policy period.  The Motion for Summary Judgment was granted and the case against the insurance carrier was dismissed.
