Clay Edwards and Katherine Vesely successfully defended a general surgeon in Fayette County Circuit Court regarding a surgery to stage and remove a lump in the patient’s breast that had been diagnosed as cancerous following a needle biopsy. Plaintiff challenged the surgeon’s clinical judgment regarding the proper extent of the surgery and staging procedure and whether a subsequent review of the biopsy slides should have been performed before the surgery. After hearing four days of evidence, the jury returned a unanimous verdict in favor of the surgeon and awarded no damages.
