James Grohmann and Julie Foster obtained summary judgment on behalf of a Lexington law firm.  The firm had represented its client in trust and estate litigation.  After the firm withdrew from that representation, successor counsel pursued the claim and filed a legal malpractice case against the firm for allegedly compromising the amount that could be recovered and delaying suit against a potentially responsible party.  James and Julie argued that the lawsuit was filed prematurely.  The trial court agreed.  It found that the case had been filed too soon, an error that could not be cured by the relation back doctrine.
