James Grohmann, Claude Tackett and Kenneth Decker successfully defended a hospital and an orthopedic surgery resident in jury trial in Louisville. The plaintiff alleged that the nursing staff and the resident had failed to monitor him postoperatively, delaying the diagnosis and treatment of acute compartment syndrome. The plaintiff eventually underwent a below-the-knee amputation of that limb. Among the witnesses for the plaintiff were experts in orthopedic trauma, nursing, physiology, forensic economics, and life care planning. James, Claude and Ken defended the care as appropriate, as plaintiff’s symptoms were consistent with what would be expected of a postop patient. They further demonstrated that the alleged delay was not a substantial factor in the outcome. The jury found in favor of both defendants.
