Don Brown and Mark Hammond successfully defended a London, KY based cardiologist in a six day trial in Laurel County Circuit Court. The Plaintiff claimed that in May 2008 the Defendant cardiologist placed an unnecessary stent in the left anterior descending artery (LAD). Brown, Hammond, and Johnson defended the case by documenting a 1 year history of chest pain preceding placement of the stent and proving that Plaintiff had no chest pain following placement. Further proof established that the cardiologist appropriately placed the stent based upon Plaintiff’s history, a positive stress test, and a cardiac catheterization that revealed significant stenosis in the LAD. The jury returned with a unanimous defense verdict in approximately 25 minutes. This was the second trial in mass tort litigation initiated in Laurel County related to cardiac stenting. Both trials have ended in defense verdicts for O’Bryan, Brown & Toner attorneys, with jury deliberations of less than 30 minutes.
