Donald Brown and Katherine Vesely successfully defended a Western Kentucky medical foundation in a medical malpractice trial in Hopkins Circuit Court. The patient’s estate alleged that the delay in diagnosing the patient’s lung cancer was the result of a negligently-interpreted CT scan. The estate further alleged that the doctors failed to detect a malignant tumor until the cancer had progressed beyond a treatable stage.
Brown and Vesely countered that the patient, a life-long smoker, died of diseases unrelated to her developing cancer. Treating physicians also testified that their recommendations for the patient to have surgery were unheeded. The defense established that the healthcare providers involved met the standard of care throughout the course of the patient’s treatment. The jury agreed and rendered a verdict for the defense.
