James Grohmann and Caroline Bruenderman obtained summary judgment on behalf of a local attorney.  The attorney had represented his client in a claim alleging wrongful conduct on the part of two police officers.  That claim was dismissed by a federal district court.  The client fired his attorney, appealed through a new attorney, and sued that first attorney for legal malpractice.

James and Caroline successfully argued that the lawsuit was not actionable, as it was filed before the underlying case was completely final.  Such a case is not “ripe” for adjudication.  The trial court agreed.  It found that not only was the case filed too soon, but it was now too late to file a proper suit.
