Mark Hammond successfully defended a London, KY based cardiologist in a three week trial in Laurel County Circuit Court. The cardiologist was accused of entering into a conspiracy with other physicians and a hospital to perform unnecessary cardiac procedures. The Plaintiff alleged that he had undergone an unnecessary stenting procedure and that a pacemaker was also later installed without necessity. Hammond defended the cardiologist by submitting that Plaintiff’s level of stenosis in a coronary artery necessitated placement of the stent and that no proof of a conspiracy to perform the procedures existed. Instead, the cardiologists who performed the procedures did so based upon Plaintiff’s presentation, and the physicians’ training and experience. The jury agreed and returned with a favorable verdict in less than an hour.
