Donald Brown successfully defended an Oldham County physical therapist and his practice group against allegations of malpractice. The Plaintiff claimed he sustained a burn during the course of electric stimulation treatment which triggered complex regional pain syndrome.
The OBT lawyers challenged the Plaintiff’s claims on both standard of care and causation. With the support of well-qualified expert testimony by a physical therapist, pain management specialist, and wound care physician, they demonstrated how the Plaintiff’s poorly-controlled diabetes could account for Plaintiff’s complaints of neuropathy and pain.
At the conclusion of a six-day trial, Plaintiff claimed over $4 million in damages. After deliberations, the jury returned a verdict in favor of the defense and awarded the Plaintiff no damages.
