David Strite and Ben Weigel successfully defended a Lexington, Kentucky orthopedic surgeon against allegations of medical negligence during a recent jury trial in Fayette Circuit Court. Plaintiff alleged that the surgeon’s intraoperative decision during a total hip replacement to change a component of the prosthesis caused severe and complete injury to her sciatic nerve. Plaintiff also alleged that the surgeon failed to adequately apprise her of the risks, benefits and alternatives of the surgery. Strite and Weigel countered that the surgeon’s decisions were appropriate under the circumstances and that the surgeon obtained appropriate informed consent from the plaintiff. The defense theory was supported by a world-renowned orthopedic surgeon specializing in total joint replacement on the faculty of the University of Iowa College of Medicine. The jury returned a unanimous verdict in favor of the defendant.
