Donald Brown and Michael Dailey successfully defended a Lexington based OB/GYN in a week-long trial. The Plaintiff claimed that the Defendant was negligent in conducting a bilateral salpingo-oophorectomy, or removal of the fallopian tubes and ovaries, triggering a blocked ureter which ultimately led to death of the Plaintiff’s kidney. Brown and Dailey challenged the Plaintiff’s theory of liability on both standard of care and causation of alleged injury. Highly regarded experts in obstetrics and gynecology, radiology and urology were retained to support the Defendant physician. At the conclusion of trial, Plaintiff claimed entitlement to over $5 million dollars in alleged damages. However, the jury agreed with Brown and Dailey and returned a unanimous verdict in favor of the Defendant physician.
